Petition To Pass The Federal Kratom Consumer Protection Act, To Overturn Any State And Local Kratom Bans, And To Halt The FDA’s Import Alert And Misinformation Campaign

This is a petition calling for the permanent legalization of Kratom in the United States, via the passage of the Federal Kratom Consumer Protection Act (KCPA) and the overturning of any state and local Kratom bans, in addition to halting the Food and Drug Administration’s (FDA) attacks on Kratom which include the Kratom import alert, spreading Kratom misinformation that is in direct contradiction with peer reviewed scientific studies, spreading this misinformation to states and municipalities in an attempt to get Kratom banned on the state and local level, and illegally declaring Kratom an unapproved food additive.
Kratom is a completely natural supplement, it is literally a leaf from the Mitragyna Speciosa tree, a tree which grows indigenously across Southeast Asia. Kratom is used by 15 million Americans according to the American Kratom Association, and there are countless reports of Kratom helping chronic pain patients and opioid dependent patients to quit dangerous synthetic opioids and opiates. There has never been a scientifically proven Kratom death in history despite 15 million Americans regularly using Kratom, unlike synthetic opioids and opiates which kill upwards of 50,000 Americans every year. Indeed, it is quite probable that Kratom use has prevented an untold amount of death and destruction, since it gives millions of Americans an alternative to dangerous synthetic opioids and opiates.
Despite the enormous benefits that Kratom has provided to millions of Americans, the FDA has endeavored to continuously release misinformation about Kratom in an attempt to get it banned. The FDA is trying to label Kratom as a dangerous and deadly opioid, despite the fact that science has proven that Kratom is fundamentally completely different than synthetic opioids and opiates, since Kratom is only a partial opioid agonist and activates G proteins while failing to recruit Beta-Arrestin, meaning that Kratom provides opioid effects but simultaneously does not cause respiratory suppression, meaning Kratom cannot cause overdoses like synthetic opioids and opiates, and also Kratom’s addiction potential is minimal due to this fundamental difference.
Even though Kratom is completely legal in most states, the FDA has declared an import alert, meaning the FDA has ordered United States Customs and Border Protection to seize any Kratom being imported from overseas, even if that Kratom is being imported by a business or individual in an area where Kratom is legal.
This petition calls for this import alert to be lifted, to prevent further unjust seizures of Kratom products.
Further, the FDA has spread misinformation as much as possible at the state and local level, so that states and municipalities would be coerced into banning Kratom.
This petition calls for an end to the FDA’s misinformation campaign, and that a law be made that the FDA can no longer contradict science and defame Kratom.
Further, this petition calls for all state and local Kratom bans to be immediately lifted, so that citizens in areas where Kratom is banned will once again have a safe alternative to synthetic opioids and opiates.
Another attack which the FDA has recently launched is declaring Kratom an unapproved food additive, by saying that Kratom which is in pill form is a food additive, since pills are taken orally. The FDA tried using this same strategy decades ago in an attempt to make black currant oil pills illegal, and a Federal Court ruled that this FDA strategy is illegal, yet the FDA is using the same strategy again for Kratom.
This petition calls for the FDA to stop saying that Kratom is an unapproved food additive, and also calls for the Department of Agriculture in each state and on the Federal level to not take any actions against Kratom.
This petition also calls for the Kratom Consumer Protection Act (KCPA) to be passed on a Federal level. The KCPA is a law which ensures that only natural, pure, and contaminant free Kratom reaches consumers. The only times in history where there has been a problem with Kratom is due to laced or contaminated products. Since the FDA has failed to make a proper regulatory framework for ensuring only safe Kratom reaches consumers, the KCPA is necessary to provide this regulatory framework.
This petition will be sent to the United States Federal Government, including all members of Congress and the President, and it will also be sent to all state governments, as well as regulators like the FDA, DEA, and USDA.
